Auction Contract/Terms

Listed below are some of the contract terms which must be understood prior to entering into an agreement with Jiffy Drop for auction services. The full contract will be available at the store for your review. Please check back on occassion because this agreement is subject to change without notice.



Glossary of Terms
Jiffy Drop LLC - Us, We, Jiffy Drop
(Client, You, Consignor) - The person turning their items over to Jiffy Drop for online auction sale.
Winner - The high bidder who wins the online auction.

Identification
Prior to signing this agreement all Consignors must provide Jiffy Drop with a valid photo ID.

Auction Seller
All items will be sold under the seller name of "jiffydropauctions" on eBay.

Auction Items/No-Sale
Upon signing of this contract You will allow Jiffy Drop to take possession of the item(s) until the end the auction. Exceptions to this rule may be made solely at Jiffy Drop's discretion based on size and space limitations.

If You maintain possession of the item(s) you may not sell or remove the items. If the item is not available for any reason to complete the transaction for which there was a winning bidder, You will be charged the standard commission plus 20% based on the winning bid price.

Jiffy Drop reserves the right to decline listing of any items that are; but not limited to:

- those which do not conform to this agreement's description of item(s) to be sold, if one is provided
- whose sale is regulated or prohibited by federal or state law
- that which cannot be listed on eBay under eBay rules
- items where Consignor's open bid price is deemed higher than would be sold for on eBay
- that which is against Jiffy Drop's terms of service , items that may be offensive or deemed harmful to Jiffy Drop's reputation.

Jiffy Drop cannot guarantee that an item will sell. If an item does not sell, You have an option of re-listing it one time at no charge. After listing or optionally re-listing an item and it does not sell you will be charged a nominal fee of $4.00 plus eBay listing fees. Items not paid for and picked up within 10 days from the end of the auction will become the sole property of Jiffy Drop and be donated or disposed of.

Listing Times
Items are normally listed so that the end dates will fall on a Friday-Sunday. So you listing time frame will very depending on which day the item is dropped off.

Cancellation
a. If Consignor wishes to cancel the auction before the item(s) is listed, Consignor must notify Jiffy Drop by phone no later than noon Eastern Time on agreed-upon listing day. Consignor will incur a nominal processing fee of $5.00 for each cancelled item.
b. Once item(s) are listed, the auction will run its full course and MUST BE SOLD TO THE HIGHEST BIDDER REGARDLESS OF PRICE, unless it is a reserve price auction and the reserve is not met. If such an instance arises that the Consignor demands the item(s) to be pulled, the Consignor will pay a cancellation fee of $25. Any item with bids that have less than 12 hours remaining will not be removed. For item(s) that are removed, they will not be surrendered to Consignor until the cancellation fee is paid in cash.

Bidding
The Consignor agrees not to bid on auctions that Jiffy Drop has listed on their behalf on eBayŽ. If such an instance occurs the Consignor agrees to pay a $50.00 fine and accepts the possibility of not being able to use the auction services of Jiffy Drop in the future. If the Consignor is the winning bidder, item(s) will not be surrendered to the Consignor until this fee is paid in cash.

Risk of Loss
Jiffy Drop will compensate You for any items which are lost, stolen or damaged while in Jiffy Drop's possession to the extent that consignor's insurance does not do so. Reimbursement for such items will be as if sold at average eBay selling price for comparable item, with applicable Jiffy Drop fees applied.

Non-paying Winner
If a Winner fails to fulfill the terms of the sale agreement, We may elect, with consignor's approval, to declare the item unsold, re-list the item or sell the item to another bidder for the amount of that bidder's high bid (which will be less than the final bid the Winner had agreed upon).

Returns
Item(s) may be returned by Winner if We are notified within 2 days of receipt of item that he wishes to return it for a refund. We will notify You of this. Upon receipt of returned item(s), Jiffy Drop will confirm item is same as item sold and issue a refund to Winner less shipping, insurance and handling fee. Jiffy Drop will apply for eBay final value fee credit. Consignor and Jiffy Drop will agree to re-list or return item as addressed in this agreement and appropriate charges will be levied as appropriate to this occurrence.

Confidentiality
Jiffy Drop maintains the confidentiality of all consignors and will not release any personal information without written consent or as required by law.

Power Outage
In the event that eBayŽ and/or Jiffy Drop's host server or ISP experiences a power outage at any time during the entire pre, post and auction process , Client will hold Jiffy Drop harmless of any damages caused by these events.

Withdrawal Of Auction
Jiffy Drop may withdraw any item from auction if We believe there are doubts to item's ownership, authenticity or attribution. Under these circumstances Consignor will be responsible for any fees incurred during the listing process and no upfront fees collected will be refunded.

Collection Fees
Consignor will be responsible for all attorney fees incurred by Jiffy Drop if legal council has to be used to collect fees owed to Jiffy Drop from consignor.

Term of Agreement
This agreement shall remain in effect until Jiffy Drop and Client agree to cease transacting business with each other or until a superceding agreement is in effect.
